County Board rejects prosecutor grant, again

For the second time in four weeks, the Gage County Board of Supervisors Wednesday rejected a grant that would have paid for a deputy county attorney to prosecute alcohol-related crimes.

Originally, the Nebraska Office of Highway Safety offered Gage County $44,000 -- one year's salary for the deputy attorney -- for the first year of the grant, 75 percent of that amount for the second year and half of it for the third year.

The grant did not cover insurance or support staff for the new attorney, and the board of supervisors feared accepting the money ultimately would be too expensive.

After the board rejected the grant, Gage County Attorney Randall Ritnour amended the grant application, and on Wednesday, asked the Board of Supervisors to accept an amended grant that would have paid $96,380 a year for three years -- enough money to cover salary, benefits and support staff in full each year, Ritnour said.

Still, the board was skeptical.

Supervisor Gary Barnard said he would prefer the county receive a grant to fund alcohol education instead of alcohol prosecution. He wondered whether there was space in the courthouse for another office and whether the grant would really reduce the number of drunken drivers on the road.

Ritnour replied that education was a part of the grant, too. And he pointed out that the position wouldn't cost the board anything.

"We're talking about a no-strings-attached grant to address a serious safety concern in Gage County," he said.

Board President Rex Adams asked Ritnour if the county attorney's office had thrown out any DUI or Minor in Possession cases due to a lack of resources to handle them.

No, Ritnour replied, but said his staff frequently works nights and weekends to stay on top of a heavy caseload in a growing county.

Supervisor Dave Anderson didn't buy that. He described Ritnour's office as "a spinning top" with lots of talk but few results.

Anderson said Ritnour has been reluctant to work on civil cases or to advise the county board on legal matters, which has led to hard feelings between Ritnour's office and board members. And, he said, he sometimes feels like Ritnour tries to manipulate the board.

Ultimately, Anderson said he didn't want to reward Ritnour's office with another attorney when it's not running the way it should.

"They're not real effective," Anderson said of Ritnour's office.

The only commissioner to speak in support of accepting the grant was Allen Grell, who pointed out that the only reason Gage County was even eligible to receive it was because it's among 23 Nebraska counties the Office of Highway Safety has identified as "high risk" based on the rate of alcohol-related car accidents and alcohol-related crimes among minors.

"They're handing us a ton of money to help make Gage County safer," he said.

In the end, the board voted 5-0 to reject the grant. Harlan Hagemeier was absent, and Grell abstained.

Gage is not the first county to do so. In the 30-year history of the grant, a handful of other counties have voted to turn down the money, said Fred Zwonechek, Nebraska Office of Highway Safety administrator.

But Zwonechek said the program does seem to be working. When the grant program was first designed, more than 40 Nebraska counties fit the eligibility criteria. Last year, 24 counties were eligible, this year, 23.

After the meeting, Ritnour said he’s not done fighting for the grant.

"We're just going to have to consider our options, and we do have some options," he said.

He declined to say what, exactly, those options were.

But he'd like the extra help both for his office and for the entire county.

"It's fiscally and morally responsible to do this," he said.

In other business the board:

n Voted to accept a preliminary budget for the 2008-09 fiscal year of $9.5 million -- an increase from $8.6 million last fiscal year. The board also voted to hold a public hearing on the 2008-09 budget on Sept. 10 at 10:30 a.m.

n Recognized Jace Bowhay for winning the world championship in the National Little Britches Finals Rodeo.

n Approved advertising for bids on new audio equipment for the Board of Supervisors hearing room. Barnard estimated the new equipment would cost around $10,000.

n Listened to Kerry Eagan, Lancaster County Chief Administrative Officer, discuss the process of combining the Register of Deeds with another county office. No action was taken on the issue.

...to tell you how this sickens me. I would like to think the elected officials of our community would support educating individuals and prosecuting those who commit alcohol related crimes.
I guess this group of Supervisors don't have children?
You should be ashamed......you might not have to answer to Mr. Ritnour or even your constituents.......but the Good Lord will hold you accountable.
I pray this community remembers the actions of those voting against this as the next election nears.

So no cases are being dropped and all the civil and criminal cases are getting done? It's just that Randy doesn't want to work so hard?

What's going to happen in three years when the grant runs out? By then they will have come to depend upon the additional attorney and will be back begging for money to fund the position and unless things improve dramatically we simply wont have the money then either.

They need to work within their budget, coming to depend upon money from outisde sources is not a good idea as the funding of those programs can change dramatically as the political winds change.

Mr. Barnard also has a very good point - education and prevention is as important as prosecution, you must treat the whole problem to be effective. Mr. Ritnour claims that education is part of the grant but gave no figures. Does the additional attorney run and present those programs or is that money separated out which would make the salary of the new attorney smaller? How do you hire a *GOOD* attorney when his position is fully funded on grants so the position's longetivity depends on politics outside the county?

Simply put, they need to learn to make do with what they have rather than depend upon the generosity of others as they may not be so generous in the future.

Although I don't always agree with the Board and how they do things, I think in this case they are right as in the long run it WILL require us to fund the position and we simply don't have the cash now or in the forseeable future.

Hmmm, Mr. Ritnour teaches NIGHT classes at Southeast Community College. So he abandons the job he was elected to do to take an additional job on and then we're supposed to hire someone to cover for him?

The county is growing?

Really, Gary Barnard? Space is an issue in the courthouse? Because didn't the county just approve an arragnement to move over 12 staff of NE Probation into the upper level of the PD? Hmmmm, try again - we all know you denied this for NO OTHER reason than your personal differences and revenge vendettas against Randy and others in the county. If you're going to lie directly to the county, at least make it plausible.

why has everybody missed the fact ritnour's grant could not be passed simply because he did not know the rules , laws , or regulations concerning these type of matters. and to think he is the head attorney in that ofice! it could not be voted aye because of his own apparent incompetenance.

I think the Board of Supervisors should consider getting the wax out of their ears and the fluff out of their brains before they spend $10,000 on new audio equipment! Did they get a grant for this?

It's interesting to me that people say we need education when it comes to alcohol abuse and yet no one shows up when there are well planned and run town meetings concerning the issue. I'm fairly new to the community and you're no different than any other, which is not necessarily a good thing. No matter how big the town, you still have your little groups and if someone is stepping on some toes they'll get shut down whether what they're trying to accomplish is beneficial to the whole or not. The board needs to get past their opinions of the county attorney and look at what's best for the county as a whole. Is he getting a little too close to their homes, or is it their kids that are underage and drinking? I wonder?

So did you do your research before writing your comment? I DID! If you look at the SCC website Ritnour teaches 1 class two nights a week. The class lasts 2 hours, so that is a whopping 4 hours a week. Next I suppose you are going to say that he is wasting time sleeping. I do not work for him, he has no idea I am writing this, but yes I do know him and think that he is doing a terrific job as CA. I think it is great that the CA is teaching classes and staying on top of new laws and how they affect the court room in today’s society as we all know has changed considerably in the recent past. I have applied for grants and received them in the past and I guess there are a few strings attached, but they are to make the grant more successful. i.e. There must be so many hours of training put forth; you have to show that the grant is successful and the like. But as far as the money goes the county would not have to pay for anything! It is sad that the grant got turned down, but I have to say that I don't know what "hey" was talking about with the rules, laws and regulations, I would be curious about that aspect.

I am very upset with the Beatrice Daily Sun as well as the Gage County Board of Supervisors. I left comment on this article on Friday, August 29. But it doesn't seem to have been one the Daily Sun chose to print here. Could it be because I pointed out that the money our illustrious board of supervisors turned down (not once, but twice!) was a GRANT, not having to be paid back or matched in any way with county taxpayer dollars! What were they thinking? The State of Nebraska determined that 24 counties have real problems with alcohol, drugs, etc. and made the money available to fight the problems. Ritnour didn't just make this up in his head so his office could get more money to spend! There is a real need in this county and education is just a portion of what's needed, Mr. Barnard. Have you ever heard of the D.A.R.E. programs that many schools have scrapped because it just didn't seem to work? Do you think if people would start getting a little more than a hand-slap when they supply booze to minors, they might think twice before doing it? There have been numerous town hall meetings and other educational opportunities in the county in the past 5 years, all focused on a community approach to curb underage drinking. Have you ever attended just ONE of them??? So much for education. What's needed is someone who will stick to the law and not let the "good old boys" be above it. Just because some of you drank when you were minors and think it's okay to let your kids (and everyone else's!) drink in your home so you know where they are, the LAW says you are wrong! People who do those things need to be held accountable! Do you want to be the one to call some mother in the middle of the night to tell her that her child was in a drunk driving accident? What if that child died? Let's educate the driver that was drinking! That will help! How much education does the board of supervisors need first??

to upset- you are ignorant of the facts. not even the death penalty has slowed the murder problwm. that is afact. so of the threat of losing ones own life can't stop someons from murdering another what in the world do you think another attorney sitting in an office is going to do to stop alcohol related violations? talk about people needing some education. you can make fun of those that support education and prevention but that is actually a more sensible approach than waiting until they commit the violation. educated folks already know that.

just in case nobody noticed, all the attorneys in the world don't stop alcohol related crimes either! not any more than an attorney would stop wife beaters, speeders, etc.. some folks just never get it. this time the county board is right. i hope this comment gets posted. i have posted others and if they don't agree with ritnour and his ilk they don't get on this blog!
