Affidavits reveal alleged murder threats by Ann Marie Kelley’s husband

Search warrant affidavits filed Wednesday in Gage County District Court shed more light on the time leading up to Ann Marie Kelley’s April 15 disappearance and include contents of conversations law enforcement officers had with former co-workers of Kelley’s husband, William Kelley Jr., in which he allegedly threatened to kill his wife.

Gage County Attorney Randall Ritnour has said the investigation into Kelley’s disappearance remains a missing persons case and her husband is a “person of interest” but not a suspect because no body or vehicle has been found.

However, he said the evidence contained in the affidavits filed this week was troubling.

“(Kelley) is still just a person of interest, but all these things cause us great concern,” Ritnour said.

So far, five search warrants connected with Kelley have been issued: one for a computer, one for a boat and pickup truck from a DeWitt residence, one for a vehicle in Beatrice and two for items from Kelley’s residence three miles east and two miles north of Filley, including one related to the missing person’s case and one related to charges filed against him recently for having sex with a 15-year-old girl from August 2006 to August 2007.

Information contained in the affidavits offer a picture of the timeline leading up to Ann Marie Kelley’s disappearance, although in one point they contradict earlier statements from law enforcement officials.

According to the affidavits, it was William Kelley and not Ann Marie Kelley who left their residence at 5:45 a.m. April 15. In the report, Gage County Sheriff’s Investigator David Heidbrink said Ann Marie received a text message from her husband at 7:22 a.m. that read, “Have a good day.” She then replied, “You too, don’t blow away.”

She and the couple’s four children then left their house sometime after 7:23 a.m. to be dropped off at school in Beatrice. In the middle of the trip, she made a purchase at the SunMart supermarket in Beatrice at 8:14 a.m.

There was later a telephone call from Ann Marie’s mother to Ann Marie at 8:45 a.m. for a duration of one minute and 14 seconds. Ann Marie, who worked for a cleaning service at Southeast Community College, used a key fob assigned to her to enter Roosevelt Hall on the SCC campus at 8:46 a.m.

She then used her phone to call her employer at 9:43 a.m. to say there was a problem with her children at school. At 9:55 a.m. there was a call from Ann Marie’s phone to the school, but no one there indicated they had a conversation with her that day.

The report filed Wednesday said there were no further sightings or contact with Ann Marie after 9:55 a.m. April 15.

At 12:29 p.m., William Kelley sent a text message to Ann Marie asking her, “What’s up?” and then another asking if she was planning to pick up their son. Her mother picked up the son after Ann Marie did not show up. Records then indicate William began to send numerous text messages to Ann Marie, but received no response.

Kelley then called Beatrice Communications at about 7:30 p.m. that day to report his wife as missing.

A sheriff’s deputy was dispatched to the Kelley residence, and a search began of all Gage County towns as well as all the bars and motels in the Beatrice area in an effort to locate Ann Marie, who would have been driving a dark gray 1991 Plymouth Voyager minivan with wood panels on the side and rear.

At about 12:30 a.m. April 16, Kelley reported finding a note and Ann Marie’s cell phone in their bedroom on their pillow. The contents of the note were not disclosed.

The affidavits filed Wednesday also contain information from conversations law enforcement officials had last week with former co-workers with William Kelley at Filley Powdercoating.

One former co-worker told Investigator Tina Vath that he worked with Kelley from July 15, 2007, to Aug. 9, 2007, and heard Kelley make comments about killing his wife.

Heidbrink later interviewed the co-worker himself, who said one day Kelley came in to work early and told him he was frustrated because he was low on money and was fighting with his wife all the time. In addition, according to the document, Kelley said he liked to fish and there were places he knew of deep enough to get a vehicle into and no one would be able to find it.

Other former co-workers said they overheard Kelly complaining about his wife spending too much money and said he often had a temper and could be easily rattled.

In the midst of the search for his missing wife, Kelley has been charged with 13 offenses, ranging from child sexual assault to possession of a controlled substance.

Ritnour, meanwhile, said the investigation is continuing.

How can they possibly think this man is not a suspect!!!???? Did he commit the "perfect" crime because law enforcement in Gage County does not know how to go about solving this case?

So do they confirm that he was at work all day??? They didn't put that in there, was he at work the day she went missing???

Hopefully this latest article has satisfied all you CSI's wannabes. Those of you who constantly complain you don't have all the details. You do realize that some facts are not released due to the fact that law enforcement does this on purpose. Let me ask you, when you play poker do you show the entire table your hand? This is not to infuriate the public, it is to catch someone who may have done something illegal. I believe everyone involved has been very forthright with the information that they do have. I still pray for her safe return.

I am NOT a csi wannabe-I am friends with Ann and want to know exactly what happened to her and where she is. I know law enforcement has to keep some things to themselves, however, she's been missing for almost 6 weeks and this is the FIRST time we get a timeline, and it's not even a good one, it's full of holes. I just wish they'd let us know more about this. I've spent HOURS driving on country roads looking for her van/and her. I want to know where she is and who's responsible.

You can call me that, I don't care if it keeps Ann as front page news. Nothing could be worse that her children thinking Mom didn't care about us and left us. I don't believe mom left voluntarily. I owe it to my friend Ann to find the truth for her kids. I will keep demanding information until the truth is known. If no one asks questions, it is soon forgotten.

I can guarantee that Ann Marie Kelley will not be forgotten. I can also guarantee that we will continue doing everything in our power to find her.

It is so easy for people to say that we don’t know what were doing. This is nothing like television. I would love to have those people who criticize our work to come spend a day, no a week with us. At this point it would take at least a week to read through the case file. Several of us are working an average of 12 – 18 hours a day on this case.

Don’t forget that this is not the only case the one investigator in Gage County has to work on, nor is it the only case the Nebraska State Patrol is working.

Your post made my day. I am so encouraged that you are reading these comments and say you won't forget Ann. In the early days when there was nothing in the paper, I thought it was just fading away. Now in light of recent developments, I can see how wrong I was and that you were on the job and laying the ground work. I can now see you are very good. I would love to come and work with you for a day. Can I?

Here are my thoughts:
1. Did she meet someone on the internet?
2. Where was Bill all day?
3. I am sure you have already interviewed the children. They would know when Mom left home. Was Bill lying when he said she left around 6am?
4. You probably know he worked for a farmer in Holmesville area at one time and knows that area. Did he fish there? There is not only the quarries, but what about the deep part of the river on the north side of the damn?
5. Did she take any personal items, photos, jewelry, her purse?
6. Where do I sign up to volunteer in the search?

So many of us have gotten used to a world of instant information from the news, the paper, the internet or a chair at the local coffee shop. Unfortuneatley we thing the local officials can jus "know" the answers as quickly as we can read about them. A sloppy investication can be done quickly but i you truly are friends of Mrs. Kelly and truly want to know the truth please calm down and wait. Let the investigators do a thorough job so they can do the job right. If something bad has happened to Mrs. Kelly you would not want the investigation to be botched because of public pressure for quick results.......or would you?

These investigators live in the area and have families as well. If you think they want this to go on any longer you are wrong. They want to know the truth as much as anybody so they can go home and tell their wife or their children that everything is okay and the bad guy or bad gal is in jail and there is nothing to worry about.

Who knows maybe the whole thing will end better and brighter than our reasonable suspicians indicate. Lets hope.

Im reading this stuff all i can say is that its not about who is doing there job right the most important thing is these kids think about how they feel and what they are going threw my heart goes out to them

I believe they are doing a great job on this case. Look at the big picture here. They had absolutely nothing to go on in the beginning and look what we know today. I'm sure some of you are Ann's friends and just want the true just like me, but lashing out at the Sheriff's dept really isn't doing anyone any good. No need to get hasty with the people commenting either. Some of them are friends that their emotions are running high and they just want answers. But everyone here wants answers and only the Sheriff's dept. is working long hours to find those answers. So give them a break. Ann won't be forgotten by anyone at this point. Those of us who knew her think about her all day I'm sure. I know I do. I worry and pray for her. Sometimes I think she is ok, sometimes I don't. Right now I'm scared. We all are I'm sure.

I certainly hope you or your family don't need any assistance from law enforcement in Gage county at any point in time.

It is small minded people like you that don't even see all of the head way being made. For heaven sake please respect what HAS been done, and stop complaining.

My heart goes out to Ann's children during this critical time!

i cant belive that people are worried about what the cops are doing or how many murders are solved my opinion is let the authorties do there job cause i dont think anyone else can do better you can talk but have you solved it yet NO so quit putting people down and start thinking about what those kids are going threw i bet at least one reads

I don't see where anyone has put the cops down. On the contrary, people were glad to hear what is going on. Of course we can't solve it, we have not been given the details needed to do the job, and nor should we, but just continual articles confirming that Ann Marie is not forgotten and the investigation is still going on, means alot to her friends and family.

I believe that the Meisenbach (spelling) murder would be the other unsolved murder.

To everyone else:

Sure we would all like to know everything that is going on, but that would not be very prudent. If all details are released then someone may not have a slip of the tongue during an interview. So be patient and let the people in charge of doing the investigation do thier job.

Good Luck and anytime you need search volunteers just put the word out, I bet we could cover alot of ground shoulder to shoulder.

I am wondering why nothing is posted on the Beatrice Daily Sun website regarding Bill's arraignment today at 2:30? I heard it on a Lincoln television channel.
